Terms & Conditions
These terms govern the use of this website and set out the basis on which Sejahtera Counsel provides legal services. Please read them carefully. If you have any questions, the firm is pleased to discuss them before any engagement begins.

1. Definitions
In these terms, the following expressions have the following meanings:
- "the Firm" / "we" / "us" — Sejahtera Counsel, a legal practice registered in Malaysia.
- "you" / "client" — the person visiting this website, making an enquiry, or engaging the Firm for legal services.
- "Services" — the legal advisory and representation services described on this website, including Pension Rights Review, EPF and Retirement Account Dispute Representation, and Civil Service Pension Appeal services.
- "Engagement Letter" — the written agreement entered into between the Firm and a client setting out the scope, terms, and fees for a specific matter.
- "Website" — this website, accessible at sejahteren.live and all pages under that domain.
2. Acceptance of Terms
By accessing and using this Website, you acknowledge that you have read and agree to be bound by these terms. If you do not agree, you should not use this Website.
These terms apply to use of the Website only. The terms on which the Firm provides legal services to a client are set out in the relevant Engagement Letter, which takes precedence over these terms in respect of any matter.
You must be at least 18 years of age and have legal capacity to enter into binding agreements to engage the Firm or submit an enquiry on your own behalf.
3. Services Described
The descriptions of services on this Website are provided for information only and do not constitute an offer capable of acceptance. No legal relationship arises from the information published on this Website.
The Firm offers three principal service lines:
- Pension Rights Review — a considered review of a client's pension entitlement, provided as a self-contained piece of advisory work
- EPF and Retirement Account Dispute Representation — representation in disputes concerning EPF accounts, including contested withdrawals and employer non-contribution matters
- Civil Service Pension Appeal — preparation and conduct of an appeal against a civil service pension determination
The scope of any specific engagement is defined in the Engagement Letter for that matter. The Firm does not undertake work outside the agreed scope without the client's written instruction to do so.
4. Engaging the Firm
Submitting an enquiry through this Website does not create a lawyer–client relationship. A formal engagement begins only when both parties have signed an Engagement Letter setting out the matter, scope, fees, and payment arrangement.
Prior to signing the Engagement Letter, the Firm will conduct identity verification in accordance with its obligations under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA) and any directions issued by the Bar Council of Malaysia. The Firm is not able to begin substantive work before this process is complete.
The Firm may decline to act in any matter at its reasonable discretion, including where a conflict of interest exists or where it does not consider the proposed engagement to be within its area of practice.
5. Your Responsibilities
A client engaging the Firm agrees to:
- Provide accurate, complete, and up-to-date information and documents as reasonably requested for the matter
- Inform the Firm promptly of any changes in circumstances relevant to the matter
- Respond to the Firm's communications within the timeframes requested, particularly where deadlines are involved
- Pay the agreed fees in accordance with the Engagement Letter
- Not ask the Firm to act in a manner inconsistent with its professional obligations as a regulated legal practice in Malaysia
The Firm's ability to act effectively on your behalf is dependent on the accuracy and completeness of the information you provide. The Firm accepts no responsibility for outcomes arising from information that was inaccurate or withheld.
6. Fees and Payment
The fees applicable to each service are published on this Website for reference and are confirmed in the Engagement Letter. Fees are denominated in Malaysian Ringgit (RM). All fees are inclusive of professional charges unless otherwise stated in the Engagement Letter.
Disbursements — including filing fees, court fees, and the cost of obtaining third-party documents — are charged separately at cost. The Firm will advise you of anticipated disbursements before incurring them.
Payment arrangements are set out in the Engagement Letter, which will specify the deposit required before work begins, the schedule for interim payments where applicable, and the arrangement for settlement of the final account.
Where a matter does not proceed to completion — whether because an engagement is terminated, a matter settles at an early stage, or a client exercises their right to cease instructions — fees are payable for work done up to the point of conclusion. The Firm will provide a written account of time and work undertaken.
Refund considerations
The Pension Rights Review is offered as a self-contained piece of work delivered on completion. Once the written report has been delivered, the fee for that service has been fully earned. For representation matters, fees are applied progressively and a written account will be prepared if an engagement concludes before completion.
7. Confidentiality
The Firm is bound by professional duties of confidentiality to its clients under the Legal Profession Act 1976 and the professional conduct rules of the Bar Council of Malaysia. All information provided by a client in the course of an engagement is treated as confidential and is not disclosed to third parties without the client's consent, except as required by law or court order, or as necessary to carry out the work instructed.
Confidentiality obligations survive the conclusion of any engagement and continue indefinitely.
8. Intellectual Property
All content on this Website — including text, design, layout, and images — is owned by or licensed to Sejahtera Counsel. No part of this Website may be reproduced, distributed, or used for any commercial purpose without the Firm's written consent.
Written work product delivered to a client in the course of an engagement — including reports, letters, and submissions — is provided for the client's use in connection with their matter. The Firm retains copyright in that work product and does not grant a licence for it to be reproduced commercially or published without consent.
9. Use of This Website
This Website is provided for information about the Firm and its services. You may use it for lawful purposes only. You agree not to:
- Use the Website in a way that could disrupt its operation or the experience of other users
- Introduce malicious code, automated bots, or other harmful processes
- Attempt to gain unauthorised access to any part of the Website or its underlying systems
- Use the Website to transmit unsolicited communications
10. Disclaimers
The information published on this Website is provided for general informational purposes only and does not constitute legal advice. No reliance should be placed on any content from this Website when making legal decisions. Any person with a legal matter should seek specific advice in relation to their circumstances.
The Firm takes reasonable care to keep the information on this Website accurate and current, but makes no representation that all content is complete, accurate, or up to date at any particular time.
Nothing in these terms or on this Website constitutes a representation as to the outcome of any matter. Honest assessments are a consistent feature of the way the Firm works; that approach does not alter the nature of legal practice, in which outcomes are subject to many factors outside the Firm's control.
11. Limitation of Liability
To the fullest extent permitted by Malaysian law, the Firm's liability to any client in respect of any matter is limited to the amount of fees paid by that client for the specific engagement in which the liability arises.
The Firm is not liable for any loss of income, loss of business, indirect loss, or consequential loss arising from use of this Website or from the provision of legal services under an engagement, except where such liability cannot be excluded by law.
The Firm's liability is not excluded or limited in respect of fraud, wilful misconduct, or any other liability that cannot lawfully be limited.
12. Termination of Engagement
A client may end an engagement at any time by written notice to the Firm. The Firm will then prepare a final account for work done up to the date of termination.
The Firm may decline to continue acting in a matter where a client has not provided instructions or information necessary to carry out the work, where fees remain unpaid in breach of the Engagement Letter, or where continuing to act would require the Firm to act contrary to its professional obligations. In such circumstances, the Firm will give reasonable notice and provide a written account of work undertaken.
Provisions of these terms relating to confidentiality, intellectual property, fees for work done, and governing law survive the conclusion of any engagement.
13. Governing Law and Disputes
These terms and any engagement between the Firm and a client are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising from these terms or from an engagement.
The Firm prefers to resolve any concerns raised by a client directly and informally in the first instance. Where a concern is raised, it will be considered carefully and a response provided in writing within 14 working days. If a matter cannot be resolved informally, the parties may consider mediation before commencing court proceedings.
Clients who are dissatisfied with the conduct of a matter may also raise concerns with the Bar Council of Malaysia, which maintains a complaints process for the regulation of the legal profession.
14. General Provisions
These terms, together with any Engagement Letter, constitute the entire agreement between the parties in respect of the subject matter they cover. They supersede any prior discussions, representations, or arrangements not recorded in writing.
If any provision of these terms is found to be unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force.
The Firm's failure to enforce any provision of these terms on a particular occasion does not constitute a waiver of that provision.
The Firm may update these terms from time to time. Changes to these terms do not affect the terms of any Engagement Letter already in force at the date of the change.
15. Changes to These Terms
The Firm may revise these terms to reflect changes in applicable law, regulatory requirements, or the services it offers. Revised terms will be published on this page with an updated effective date. Continued use of the Website after the effective date of any revision constitutes acceptance of the revised terms.
